Telephone Consumer Protection Act Exemptions

If you work by or are home long enought to get a phone call you most likely have received many from automated dialing services that seek to sell or lure you into something. Geez, I thought those things went away with the TCPA and Do Not Call Lists.

Well, guess again! Evidently, if someone can get your name from a leads house, alleging that you at some time requested some kind of info, you’re going to have to deal with it!

Also, there are thos who are exempt from the Federal and state laws as well!

The Telephone Consumer Protection Act (TCPA)  the Federal Trade Commission and the Federal Communications Commission do not call list registry rules and various State laws place restrictions on certain types of phone calls.

  • Typically a call may be exempt from the TCPA if the call:
  • Is made on behalf of a non-profit organization.
  • Is made to a consumer with whom the calling company has an existing business relationship.
  • Business to business contact.
  • Does not include an unsolicited advertisement, even if the call is made for commercial purpose. Is survey work.

May I have Your Permission to Solicit you? 

HyperDialer is a service that has a “permission based introduction” feature that can be used free of charge. This feature allows only those consumers who have provided proper permission to listen to the “recorded solicitation” part of the call. If permission is not granted, then the solicitation is not presented. Recipient provides proper consent prior to playing the “recorded solicitation”.
